This Agreement Includes

This quote will not include
Excess reduction insurance. Please see our Excess Reduction Guide for
further details. Extra kilometre travel (if your rental is limited, the limit can not be extended, and each km will be charged at $0.25 - $0.33* depending on location). A 3% Administration Fee & Airport Concession Fee (if applicable) will be added to any extra charges and optional extras nominated at time of rental. All extra add-ons will attract additional percentage taxes and surcharges.
Modifying Booking
Modifying your booking may change the original quoted price.
Cancel Booking
Cancelling your booking within 7 days of Rental will incur a 50% cancellation fee of the original quoted price.
Drivers Licence
The renter must have held a valid LR or above driver's licence for at least 12 months and must present it at the time of rental. The licence must be valid at the time of rental and remain valid throughout the rental period. All drivers must meet ‘Owners’ requirements. The license is checked for validity by noting the following: Provincial (state) seal or stamp Expiration date Description of the renter Traffic violations License signature Erasures or
corrections are not accepted unless authorized by issuing province (state).
Restrictions:
Individuals with Learner's Permits, Provisional or Probationary licences may not operate Owners vehicles. Owners is unable to rent a truck to anyone with a suspended, revoked, expired, cancelled or surrendered driver's licence.
International driver's licences accepted by Owners in Australia:
A driver's licence issued by any state or territory in Australia or New Zealand.
A driver's licence issued by any United States, territory, or possession. Any foreign renter must carry a driver's licence written in English. Any customer carrying a non-English licence must also present an International Driving Permit that is written in English. International driving permits serve only as a translation, and are valid if presented in conjunction with an official driver's licence of the issuing country.
Additional Drivers
The following individuals, if 25 years of age or older and in possession of a valid driver's licence may drive the car with the renter's prior permission:
Renter's employer (while on company business) or, Renter's fellow employee (while on company business)
Renter's spouse or life partner
The above additional drivers are considered "authorised drivers" and need not be present at the time of rental nor do they need to sign an additional driver form. Other individuals may be listed as additional drivers provided they are at least 25 years of age; present a valid driver's licence and complete an additional driver form.
Cash Rentals
Although you present a major credit card at the time of rental, when you return the vehicle, you will be asked (unless transaction already processed) if you'd like to keep the rental charges on that credit card or pay cash. Since car rental companies ask for credit approval on the estimated car rental charges when you pick up the car, that amount will be held against your credit balance on that card for up to 14 days, regardless of how you pay upon return.
Credit Cards
Owners accepts Visa and MasterCard credit cards as credit identification at the time of rental. Acceptable credit cards include: MasterCard and Visa. Credit Card surcharges apply @ 1.7% of the total transaction value.
Debit Cards
No Debit cards are accepted in Australia.
Age
In Australia the minimum age is 25 for trucks.
Off Road Driving
Owners vehicles may not be operated on non-paved roads. Driving of vehicle on beaches is not permitted. Vehicles are not allowed to be taken onto ferries or cross bodies of water.
Tow Bars
Tow bars (or trailer hitches) may not be used with any Owners vehicle.
Late Charges
Most Owners rentals are based on a 24 hour day. A car rented at 10AM for a one-day rental is due back at 10AM the next day. There is a 59-minute grace period. If the car is returned within the 59-minute grace period there will not be any additional hourly rate. Beyond the 59-minute period, an hourly rate will apply until it equals the rate for an additional day. Charges for optional services such as Excess Reduction, etc. are charged as full days after the 59-minute grace period. If a vehicle is returned beyond the parameter associated with a specific rate code the rental may revert to a higher applicable rate.
Where you can/ cannot drive the vehicle
You and any Authorised Driver must only use the Vehicle on a road which is properly formed and constructed as a sealed, metalled or gravel road.
You and any Authorised Driver must not, unless authorised in writing by Owners, drive or take the Vehicle:
(a) to Kangaroo Island, Bruny Island or Fraser Island;
(b) into or out of the Northern Territory, Tasmania or to any points in Western Australia
north of Carnarvon;
(c) in Queensland:(1) Highway No.27 beyond Chillagoe in a westerly direction;(2) Highway No. 1 beyond Normanton in a southerly direction; and no further North than Karumba(3) if the Vehicle is a passenger vehicle or truck, beyond Cooktown to the North or Lakeland to the West and no further north than Cape Tribulation on the coast road.(4) On the coast road from Helensvale to Cape Tribulation, or from Laura to Lakeland,
(d) above the snow line in Tasmania, New South Wales and Victoria (being Jindabyne in New South Wales and Bright in Victoria) from the beginning of June until the end of September
(e) on beaches or through streams, dams, rivers or flood waters.
Use of the vehicle
You and any Authorised Driver must:
(a) not allow the Vehicle to be used for any illegal purpose, race, contest or performance test of any kind;
(b) not allow the Vehicle to be used to tow or push anything;
(c) not carry more passengers than may be properly accommodated by the seat belt restraints provided in the Vehicle, or carry a greater load than that for which it was built;
(d) not be under the influence of alcohol, drugs or have a blood alcohol content that exceeds the legal limit in the State or Territory in which the Vehicle is driven;
(e) not allow the Vehicle to be used to carry passengers for payment of any kind;
(f) not use the Vehicle when it is damaged or unsafe;
(g) not use the Vehicle to transport goods, except in compliance with all necessary approvals, permits, licenses and government requirements (to be obtained at Your cost) and in accordance with the Vehicle manufacturer's and Owners recommendations;
(h) not, without Owners prior written consent, use the Vehicle to carry any flammable substance which has a flash point under 22.8°C or any other explosive or corrosive substances; and
(i) not use the Vehicle in contravention of any law.
You must pay for any unauthorised repairs to the Vehicle and for all parking and traffic infringements in respect of the Vehicle during the Rental Period.
Unacceptable wear & tear
Any stain, mark that cannot be removed by general cleaning will incur a cleaning charge. Any scuff or scrape that cannot be polished out , any damage to sidewalls of tyres will need to be repaired or replaced at renters cost.
Acceptable wear & tear
Stone damage up to 2mm, scratches that can be polished out, light marks that can be removed by general cleaning.
Your truck rental insurance excess
Standard Liability $5500 (excluding taxes and local fee)
Full Protection Package - $36.30 (per day excluding local fees and surcharges) This package reduces your liability to $1550 and includes reasonable damage to Windscreen Headlights. It will be deemed misuse and not covered under owners insurance and therefore the renters responsibility if vehicle is not used in accordance with manufacturers and owners guidelines and recommendations.

Terms and Conditions of Hiring
Please be advised that terms may be stated more than once throughout agreement.
1. In this Agreement unless the context otherwise requires.
1.1 "Vehicle" means the motor vehicle(s) referred to in part A of the schedule and shall include all tyres tools spare parts accessories and safety equipment supplied with the Vehicle described in Part A of the schedule.
1.2 "The Insurance" means the policy of insurance arranged by the Owner in the name of the Owner for the purpose of covering damage to the third party property.
1.3 "The State" means any State or territory of Australia.
1.4 Words importing the masculine gender shall include other genders and words importing the singular number shall include the plural References to persons shall include corporations. References to "Owner" and "Renter" shall include their respective successors, personal representatives and assigns. Where there is more than one Renter the term "Renter" shall include such persons both jointly and severally.
2. The Renter warrants that:
2.1 The Renter is over the age of 25 years;
2.2 The Renter holds a current licence valid in the State for the type or class of Vehicle rented;
2.3 All particulars shown in the the schedule are correct and the Renter acknowledges that the Owner relies on the truth of these representations;
2.4 Before signing this Agreement the Renter has examined the Vehicle and satisfies himself as to its condition safety suitability and roadworthiness for the Renter's purpose and agrees that no warranty condition description or representation on the Owner's part is given other than such (if any) as are contained in this agreement;
3. The Renter agrees:
3.1 That the Renter and the Joint Renter (if any) are jointly and severally responsible for payment of all charges incurred under this agreement;
3.2 That unless the Owner agrees to accept payment by the use of a credit card payment for all charges under this Agreement is due in cash at the end of the rental period;
3.3 That charges not paid on time as required by this Agreement may be subject to a late payment fee. The Renter may also be charged a fee for any cheque used for payment that is returned unpaid.
3.4 That the Owner makes an error or omission in calculating charges due or if the Owner is unaware of certain charges upon return of the Vehicle the Owner may make further demands on the Renter and the Renter agrees to pay such charges immediately on receipt of the demands.
3.5 That if the Renter uses a credit card to pay the charges the Renter authorizes the Owner to reserve credit with the card issuer in an amount equal to all estimated charges that the Owner may debit the Renter's account with ant charges incurred under this Agreement. Paying with cash does not incur any credit card charges.
4. The Renter agrees:
4.1 That no person other than the Renter /Joint Renter /authorised additional driver/s are authorized to use drive or operate the Vehicle;
4.2 That if the Vehicle is damaged such that its further use may be likely to cause injury or damage to any person or property the Renter shall not use the Vehicle whilst it remains so damaged; and
4.3 To return the Vehicle to the Owner in good mechanical and physical order and condition at the Renter's premises on the date and time specified in item 4 of the Schedule.
4.4 The vehicle is not deemed to be returned until owner or authorised person takes possession of keys and officially checks vehicle in.
5. The Renter shall not without the consent of the Owner first obtained in writing:
5.1 Part with possession of the Vehicle during the period of hire;
5.2 Make or give any offer, promise, payment, settlement, waiver, release, indemnity or admission of liability in respect of any accident damage to the Vehicle or the poroperty of any third person of injury to any person whatsoever.
6.The Renter shall not alter or make an addition to the Vehicle.
7. The Renter shall not:
7.1 Cause or allow the use of the Vehicle for the conveyance of passengers for hire fare or reward.
7.2 Use the Vehicle for any illegal purpose or in contravention of any law of the State;
7.3 Drive the vehicle under the influence of any alcohol or drug or with a
blood alcohol level as indicated by analysis of the driver's breath or blood in excess of that permitted by law of the State.
8. The Renter agrees:
8.1 To pay all parking and traffic violation fines and penalties for offences committed by the Renter and to pay all levies duties imposts and other charges imposed by any government body in any way connected with the Renter's use of the Vehicle whether received by the Owner or the Renter relating to the period of the use of the Vehicle by the Renter;
8.2 To indemnify and hold the Owner harmless if the Owner pays the fines levies duties imposts and other charges charges referred to in Clause 8.1 hereof and to reimburse the Owner for its related collection and other expenses;
8.3 That the Owner is hereby authorized to release to any government body any information relating to any person who uses the Vehicle during the rental period
8.4 The renter agrees to maintain fluid levels and monitor temperature of vehicle for duration of agreement. Renter must report to owner immediately any defect which the renter becomes aware of.
9 The Owner shall not be under any liability for any property stolen from the Vehicle or damaged while in the Vehicle or left in the Vehicle after its return to the Owner.
10 The Renter shall be liable for and shall indemnify the Owner from and against any damage action legal liability loss claim or proceedings in respect of:
10.1 Any injury or damage whatsoever to the Vehicle and/or to any property real or personal arising out of in the course of the use of the Vehicle by the Renter or by any act or omission of the Renter whether or not the same is due to the negligence omission or default of the Owner;
10.2 Any statute or common law dealing with personal injury to or death of any person whomsoever arising out of or in the cause of or caused by the use of the Vehicle by the Renter;
10.3 Any false inaccurate or misleading statement in relation to the making of this Agreement;
10.4 Any breach of the terms and conditions of this Agreement by the Renter.
11. The Renter agrees that the Owner shall not be responsible for any loss damage or delay caused to the Renter as a result of any breakdown mechanical defect or other failure in the Vehicle.
12. 12.1 The Renter shall immediately notify the Owner if the Vehicle is destroyed or damaged or of any event which might lead to a claim under the insurance effected by the Owner and to do all things which the Owner may reasonably require to be done to enable the owner to receive indemnity under the insurance;
12.2 The insurance does not in any circumstances extend to any Renter carrying volatile liquids, gases, explosives or corrosive materials with or without the Owner's consent;
12.3 Subject to clause 12.4 in the event of any claim upon the insurance by the Owner resulting from the use of the Vehicle by the Renter shall in respect of each claim pay the following excess;
(a) Where the vehicle is being driven by a person over the age of 25 years the sum of $1550.00
12.4 In the event that any claim upon the insurance by the Owner resulting from the use of the Vehicle by the Renter is in any respect rejected waived or denied either whole or in part by the insurer of the insurance then the Renter shall be liable to the Owner for all and any loss cost or damage to the Vehicle and the Renter shall indemnify and keep indemnified the Owner accordingly.
13. Notwithstanding anything contained in this Agreement where the Vehicle is a truck van minibus car or recreational 4 wheel drive the Renter shall be liable for The cost of repairing overhead or roof damage caused by, but not limited to, contact between the vehicle and objects overhanging or obstructing the path of the vehicle; or the cost of repairing any water damage to the Vehicle or any under body damage, and any resulting damage from that underbody damage, to the Vehicle or when reversing backwards. As stated in page 1
14. The Owner may determine this Agreement and without notice repossess the Vehicle in the event of a breach by the Renter of the terms and conditions of this Agreement.
14.1 Notwithstanding anything in this agreement, animals flora or fauna and or single vehicle accident if driver has driven unlawfully or outside vehicle and owners specifications and recommendations is at driver's liability and any waiver purchased by the Renter or driver is voided as well as basic insurance.
